  • CSJ Marketing shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, revenue, business, goodwill, or anticipated savings, whether arising under contract, tort (including negligence), breach of statutory duty, or otherwise.
  • CSJ Marketing’s total liability for any claims arising out of or relating to the provision of services shall be limited to the total fees paid by you for the specific services giving rise to the claim.

All information, advice, and services provided by CSJ Marketing are intended for general marketing guidance only and do not constitute legal, financial, or other professional advice.

You are responsible for conducting your own due diligence before acting on any marketing strategies, and you agree that CSJ Marketing shall not be liable for any financial loss, claim, or damages arising from your use of the information or services provided.

9. Client Responsibilities

Clients working with CSJ Marketing agree to:

  • Provide clear and timely information, approvals, and feedback when reasonably requested
    Ensure they have the appropriate rights, licenses, and permissions to supply any content, materials, or data to be used
    Maintain open communication to avoid unnecessary project delays

Failure to fulfil these responsibilities may result in delays or affect the quality and outcome of services.

10. Payment Terms

All payments for services are due as agreed upon in the project proposal or invoice.

  • CSJ Marketing reserves the right to charge late fees for overdue invoices.
  • Work remains the intellectual property of CSJ Marketing until full payment is received.
  • Continued delays in payment may result in the suspension or termination of services.

11. Intellectual Property

Unless otherwise agreed in writing:

  • All deliverables, materials, and content created by CSJ Marketing remain the intellectual property of CSJ Marketing until full payment is received.
  • Upon receipt of full payment, clients are granted a non-exclusive, non-transferable right to use the deliverables for their intended purpose.
  • CSJ Marketing reserves the right to display completed work in a portfolio or marketing materials unless agreed otherwise.

12. Jurisdiction and Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the English courts.

13. Changes to These Terms

CSJ Marketing reserves the right to update or modify these Terms and Conditions at any time without prior notice.
Updates will be posted on this page with a revised effective date. Continued use of the site after any changes constitutes acceptance of the new Terms.

14. Refund and Cancellation Policy

  • Deposits and Payments
    All deposits and advance payments are non-refundable. These secure your booking and compensate for time allocated to your project.
  • Refunds
    Once work has commenced, fees paid are non-refundable, regardless of project outcome or client decision to discontinue services.
    Partial refunds may be offered at CSJ Marketing’s sole discretion if minimal work has been completed.
  • Cancellations
    If you choose to cancel a project before work has started, no further charges will apply beyond any non-refundable deposit.
    If cancellation occurs after work has begun, you will be invoiced for all work completed up to the cancellation date.
    CSJ Marketing reserves the right to cancel services if necessary, with reasonable notice and a refund for any services not yet provided.

15. Amends and Revisions

We’re always happy to make reasonable amends whether that’s refining a social media post, adjusting a strategy, or updating web content. A fair number of revisions are included as part of our service to ensure you’re happy with the final result.

However, where the volume or nature of changes becomes excessive, repetitive, or falls outside the original scope, we reserve the right to treat these as additional work. In such cases, any extra costs will be confirmed in advance, based on the complexity and time required to implement the requested changes.

16. Additional Work Outside of Scope

While we’re flexible and collaborative, any new work requested that falls outside the agreed project scope, such as introducing additional strategy elements (e.g. a Mailchimp campaign added after a social strategy is complete), new content streams, or technical extras beyond domain transfers such as advanced server setups, or email configurations, or additional pages above what has been quoted will be treated as separate or additional to the original brief.

In these cases, we reserve the right to quote for the work as a new task or bolt-on, with costs confirmed in advance based on the time, tools, and complexity involved. This applies to all projects, including websites, marketing strategies, and any other ongoing services. If it wasn’t in the original scope, we’ll make sure it’s clearly priced and agreed before moving forward.

17. Force Majeure

CSJ Marketing shall not be held liable for any delay or failure to perform obligations under these Terms if the delay or failure arises from events beyond our reasonable control. This includes (but is not limited to) acts of God, natural disasters, pandemics, strikes, internet outages, platform disruptions, civil unrest, or governmental restrictions.

18. Website Transfer & Backup Fees

Should you wish to move your website away from our hosting or management services, we’re happy to assist. A one-off website transfer and backup fee of £129 will apply. This covers the creation of a full site backup, export of relevant databases and files, and reasonable server admin time to ensure a clean handover.

Additional technical support or migration assistance beyond this (such as setting up mailboxes, troubleshooting with a new host, or restructuring site files for compatibility) may incur further charges, which will be quoted and agreed in advance.

19. Third-Party Tools and Access

Where services rely on third-party platforms or tools (such as Google, Meta, Mailchimp, WordPress, or hosting providers), the client is responsible for maintaining account access, payment of any associated fees, and ensuring service continuity. CSJ Marketing is not responsible for downtime, limitations, or disruptions caused by third-party providers or the client’s failure to manage these platforms.

20. Website Design Terms & Limitations

All website design and development work is carried out in line with the agreed project scope, including (but not limited to) the number of pages, features, layout style, integrations, and overall functionality.

Content, Assets & Client Responsibilities

Unless otherwise agreed as part of a content plan, copywriting service, or image sourcing package, clients are responsible for supplying all website content, images, brand assets, and access credentials in a timely and organised manner.

CSJ Marketing is not liable for project delays caused by missing or late content, extended sign-off processes, slow feedback loops, or client-side proofreading and approval stages.

We are also not responsible for any reputational damage, missed business opportunities, or financial loss resulting from:

  • “Coming Soon” or temporary holding pages

  • Delayed launches due to incomplete content or delayed approvals

  • Website transfers, DNS changes, or domain migrations — particularly where third-party providers are involved

All delivery dates are indicative and rely on timely input and communication from the client.

Post-Scope Changes

Once a website has been signed off, launched, and invoiced, the agreed scope of work is considered complete. Receipt of the final invoice generally marks the end of the project.

While we allow for a brief, undisclosed grace period and aim to be fair and accommodating — particularly where changes relate to typos, clear errors, or would be unreasonable to charge for if within this grace period — any additional requests, updates, or future changes beyond this will be treated as new work and quoted accordingly, in line with our Additional Work policy (see Section 16).

This includes (but is not limited to):

  • New pages or sections

  • Replacement or additional content

  • Image swaps or additions

  • Updates to contact information (e.g. phone numbers, email addresses)

  • Functional, structural, or stylistic changes not included in the original scope

Browser & Device Compatibility

All websites are built to function responsively across modern devices and are tested on the latest versions of major browsers (Chrome, Safari, Firefox, Edge).
We do not guarantee perfect visual or technical performance on outdated browsers or legacy devices.

Third-Party Involvement

If third-party developers, plugin installers, SEO providers, or marketing agencies are involved during or after launch, CSJ Marketing is not responsible for any changes made by those parties or for issues caused by conflicting plugins, coding errors, or unauthorised modifications.

Post-Launch Responsibility

Unless a hosting or management agreement is in place, the client assumes full responsibility for the website after launch.
We strongly recommend avoiding structural, plugin-related, or performance-altering changes without the appropriate technical knowledge.

Even for websites hosted by CSJ Marketing, any changes made by the client, or any issues or breakages resulting from those changes, are not our responsibility. If the client requests assistance in resolving such issues, this will be quoted and charged on a case-by-case basis.

For websites hosted externally, our ability to provide support is naturally limited due to unfamiliar server stacks, inconsistent plugin setups, and varying third-party environments. As we do not manage or maintain those hosting environments, we cannot offer guaranteed support — though we’ll always be helpful where reasonably possible.

For websites hosted by CSJ Marketing, we will of course provide support where issues arise that are within our remit and direct responsibility. If problems stem from third-party interference or client-side alterations, we’ll do our best to advise — but fixes may require additional work and will be quoted separately if necessary.

21. Website Performance

21.1 Sites Hosted by CSJ Marketing

Websites hosted by CSJ Marketing are launched on a modern, high-performance server stack designed to meet current SEO and user experience standards. Our builds use lightweight, clean-coded techniques to ensure fast load times, technical stability, and responsive performance from day one.

While we monitor uptime and security closely, we are not liable for brief or temporary service interruptions caused by scheduled maintenance, third-party data centre issues, or events outside of our control. In the unlikely event of significant downtime within our control, we will work urgently with our hosting partner to restore service as quickly as possible.

Please note that prolonged outages caused by events outside our reasonable control — including natural disasters, server infrastructure failure, or internet-wide disruptions — are considered Force Majeure events and are governed by Section 17 of these Terms.

Web hosting is billed monthly. If payment is missed or delayed, we reserve the right to suspend access to the hosted website until the total outstanding amount is paid. For each month the site remains suspended, the standard or agreed monthly hosting cost will continue to apply, depending on the hosting agreement in place.

For example, if a site is suspended for two months, the client will owe the original missed month, plus two months of suspended hosting, along with a £50 admin and reconnection fee. This policy applies regardless of whether the suspension lasts two months, six months, or longer.

We are not liable for any disruption, data loss, reputational damage, or business interruption resulting from suspended hosting due to non-payment.

If performance issues arise after launch due to client-side alterations — such as uploading large media files, installing resource-heavy plugins, or providing access to third parties — CSJ Marketing accepts no responsibility for resulting slowdowns, loss of service or negative SEO impact. If the client wishes to restore the site’s original performance, we may offer a paid re-optimisation service, quoted on a case-by-case basis.

21.2 Sites Hosted Elsewhere

Where websites are hosted externally (i.e. not on servers managed by CSJ Marketing), we have no control over server speed, technical reliability, plugin compatibility, or uptime. In these cases:

  • Our responsibility is limited to the design, layout, and front-end delivery as per the original scope, or any specifically agreed SEO work.

  • We are not liable for any performance, speed, or downtime issues stemming from the client’s chosen hosting environment.

  • If the client or a third party makes changes that negatively affect performance, we will not offer optimisation or support, as this falls outside our managed infrastructure and standards.

Clients should be aware that poor hosting can directly impact SEO, user experience, and security. We strongly recommend using a reliable, professional-grade hosting provider if you choose not to host with us.

Furthermore, if SEO work is carried out on an externally hosted site, CSJ Marketing is not liable for lack of SEO performance where poor hosting, third-party plugins, or site speed are believed to be contributing factors. As outlined in Section 21, SEO is a volatile and long-term process — but these technical limitations may further reduce effectiveness where we are not in control of the hosting environment.

22. SEO Disclaimer & Results Expectations

We provide SEO services based on industry-recognised best practices aimed at improving organic visibility, traffic, and lead generation over time. However, we do not and cannot guarantee first-page rankings, traffic increases, or specific performance outcomes.

SEO is influenced by many external factors — including competitor activity, algorithm changes, content frequency, site speed, domain authority, and backlink profiles. Unless part of a dedicated SEO package or wider marketing strategy agreed with us in writing, we are not responsible for the absence of supporting efforts, such as:

  • Social media activity

  • Blog content or regular on-site updates

  • Backlink building or outreach

  • Paid advertising

  • Additional technical SEO work or plugin integration

Where only basic SEO is provided — such as with a new website designed by CSJ Marketing (whether hosted by us or the client) — this typically includes technical setup, SEO-friendly page structure, meta titles/descriptions, and indexing support. While these elements often vastly improve performance compared to older or poorly built sites, they do not guarantee rankings or lead volumes in isolation.

If a new site replaces a larger, older website (e.g. a 50-page site replaced with a cleaner 15-page version), it’s possible to see improvements in design, user experience, and conversions — but also reduced traffic or changes in rankings, especially if the previous site had built up search equity over time.

Sites hosted by CSJ Marketing are built on a modern, performance-focused server platform using lightweight, best-practice techniques to meet current SEO and user experience standards. From launch, these sites are structured to be fast, responsive, and technically sound.

However, if a client later adds excessive media, installs incompatible plugins, or makes other changes that degrade performance, CSJ Marketing is not liable for the resulting impact on SEO performance.

Likewise, if a website is hosted externally, we have no control over server speed, uptime, or optimisation tools. Poor performance caused by third-party hosting — including slow loading times or technical bottlenecks — may directly hinder SEO outcomes. In these cases, we accept no responsibility for SEO effectiveness and do not offer re-optimisation or technical support for environments outside our control.

SEO is not instant. For meaningful results, a consistent, multi-channel effort over a number of months is typically required. If SEO is a key business goal, a structured SEO package or long-term marketing plan should be scoped, quoted, and agreed separately.
